RECESS
The right of withdrawal can be exercised with or without registration on the Site. The Buyer has the right to withdraw from the contract, without any penalty and without specifying the reason, within 14 (fourteen) days from the day of receipt of the purchased Product, except for the exceptions provided by Article 59 of the Consumer Code (Legislative Decree no. 206/2005).
HOW TO REQUEST WITHDRAWAL
If the Buyer decides to exercise the right of withdrawal, they must access the “Orders” section available at https://www.filifolli.it/en/my-account/ordini/, select the order with the product to be returned, and use the “Make Return” button, or submit any other explicit statement of their decision to withdraw from the contract (“Withdrawal Declaration”), indicating the order number, the Product(s) for which they intend to exercise the right of withdrawal, their name and surname, address, and, if desired, the reason for the return. The Withdrawal Declaration must be completed in all its parts and sent to the Seller by email to consumer@filifolli.it, by registered letter with return receipt, or by certified email (PEC).
Once the return request is received, the Seller’s Customer Service will provide the Buyer with instructions on how to return the Product within 4 working days. The Product must be returned within 20 days from the date on which the Buyer communicated their decision to withdraw to the Seller.
The right of withdrawal is subject to the following conditions:
- The substantial integrity of the Product is an essential condition for exercising the right of withdrawal. The Product must be kept with ordinary diligence and returned intact, complete in all its parts, without signs of wear or dirt, and must not have been used, worn, washed, or damaged;
- The Product must be returned in its original packaging, complete in all its parts (including the identification tag, which must still be attached to the products with the single-use seal, and the barcode labels, which must not be damaged, as they are an integral part of the product);
- In case of promotional product purchases (e.g., 3×2, 4+1, special price multipacks, etc.), the withdrawal must be made for all the Products on which the promotion was applied.
The Buyer cannot exercise the right of withdrawal for contracts for the purchase of goods made to measure or clearly personalized or that, by their nature, cannot be returned or are liable to deteriorate or expire rapidly, sealed products that are not suitable for return for health or hygiene reasons or that have been opened after delivery, and in any other case provided by Article 59 of the Consumer Code.
EXPENSES
The only costs due by the Buyer for exercising the right of withdrawal under this article are the costs of returning the Product to the Seller (including transport costs).
The Seller will refund the price paid by the Buyer for the returned products, excluding the costs for returning the same, within 30 (thirty) days from the proper return of the Products. To be entitled to a full refund of the paid price, the Products must be returned intact and complete in all their parts, without signs of wear or dirt, and must not have been used, worn, washed, or damaged. The Product must be returned in its original packaging, complete in all its parts (including the identification tag, which must still be attached to the products with the single-use seal, and the barcode labels, which must not be damaged, as they are an integral part of the product). Additionally, the Buyer must have fully paid the costs of returning the Products. If the return costs of the Products are not paid, the Seller may refuse to accept the returned Products.
Upon receipt of the communication in which the Buyer notifies the exercise of the right of withdrawal, the parties to this contract are released from their mutual obligations, subject to the provisions of this article.
